Terms of Service

These terms govern your use of the Suns Out Charters website and every boat rental or charter booked through it.

1. Agreement to these terms

By browsing sunsoutcharters.com, creating a booking request, or stepping aboard a vessel arranged through us, you agree to these Terms of Service. If you are booking on behalf of a group, you accept these terms for every member of your party and are responsible for making sure they follow them.

2. What Suns Out Charters is

Suns Out Charters is a marketplace that connects guests with independently owned and operated vessels, licensed captains, and charter operators across Florida. Unless stated otherwise on a listing, the vessel owner or operator — not Suns Out Charters — is the party providing the trip, and the trip is also subject to that operator's own rental agreement, which you sign at check-in.

3. Eligibility

You must be at least 21 years old to book a charter and to sign the operator's rental agreement. Every guest under 18 must be accompanied by a parent or legal guardian. For self-drive rentals, the renter must present a valid government-issued photo ID and, where required by Florida law, a boating safety education ID card.

4. Bookings, pricing and payment

Prices shown are per vessel, not per person, and cover the listed charter duration. A deposit is charged to confirm a reservation; the balance is due before departure unless the listing says otherwise. Fuel, gratuity for the captain and crew, water-toy add-ons, docking or launch fees, and applicable Florida sales tax may be additional and are disclosed before you pay.

A refundable damage hold may be placed on your card by the operator and released after the vessel is returned in the condition it left in.

5. Weather, safety and captain authority

The captain or operator has final authority over every trip and may shorten, reroute, or cancel a charter for weather, sea state, mechanical issues, or guest safety. Their decision is not negotiable. Weather-related cancellations are handled under our Cancellation Policy.

Life jackets must be worn by all children under six while underway and by any guest the captain directs to wear one. Guests must follow all captain instructions at all times.

6. Guest conduct

Illegal drugs, glass containers, fireworks, firearms, and smoking (including vaping) are prohibited on board unless a listing explicitly allows it. Operating a vessel under the influence is illegal and strictly forbidden. Passenger capacity listed on the vessel placard may never be exceeded, including infants.

The captain may end a charter without refund if guests are unsafe, abusive, damage the vessel, or violate these rules.

7. Damage and loss

You are responsible for damage to the vessel, its equipment, and water toys caused by you or your party beyond normal wear, as well as for lost or unreturned equipment, excessive cleaning, and fuel not replaced as agreed. Charges are assessed by the operator and may be applied to your card on file.

8. Assumption of risk and liability

Boating, swimming, and water activities carry inherent risks including injury, illness, seasickness, property damage, and death. You voluntarily assume these risks for yourself and your party. To the fullest extent permitted by Florida law, Suns Out Charters is not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to a booking is limited to the amount you paid us for that booking.

9. Content and intellectual property

The Suns Out Charters name, logos, photography, listing copy, and site design are our property or used under license, and may not be copied, scraped, or reused without written permission.

10. Changes and governing law

We may update these terms; the version posted at the time of your booking applies to that booking. These terms are governed by the laws of the State of Florida, and any dispute will be resolved in the state or federal courts located in Florida.
